The Peruvian government recently updated its entry restrictions for Peruvians, residents and non-resident foreigners.

Key Points:

  • As of Sept. 25, Peruvian citizens, resident foreigners and non-resident foreigners traveling to the Peru from any country must:
    • Have a negative molecular test taken within 72 hours of departure.
  • Authorities suggest that individuals be fully vaccinated and show their vaccine records.
  • Non-resident foreigners traveling from or who have been in South Africa within 14 days of intended arrival in Peru are barred from entering the country until at least Oct. 3.
    • Peruvians and resident foreigners who are traveling from or who have been in South Africa within 14 days of intended arrival quarantine for 14 days upon arrival.

The Peruvian government published a new resolution on Aug. 6 that repealed a number of key immigration provisions.

Key Points:

  • Extensions of temporary and resident immigration statuses that were granted since March 16, 2020, according to the previous resolution, will only be extended until the new resolution is enacted.
  • Foreign nationals who have not been granted an extension of immigration status and received an exit order have 15 days from the tenth day of the new resolution’s publication to leave the country.
    • Individuals who overstay their visa will be subject to an overstay fine beginning 10 days after the resolution’s publication.
  • The authorization for foreign nationals to stay outside the country for 30, 183 or 365 calendar days will be resumed on the tenth day after the resolution’s publication.

Additional Information: Foreign nationals with an irregular immigration situation since Oct. 22, 2020, must now request for immigration regularization. Beginning Aug. 17, the deadlines will be resumed.

The Peruvian government recently extended the State of National Emergency for an additional month and updated COVID-19-related travel restrictions.

Key Points:

  • Until Aug. 22, non-resident foreigners who have stayed in or transited through Brazil, India or South Africa within 14 days of intended arrival are not allowed to enter Peru.
  • Peruvians or resident foreigners coming from or transiting through Brazil, India or South Africa will be allowed to enter the country but must complete a 14-day mandatory quarantine upon arrival.
  • Peruvians, resident foreigners and non-resident foreigners who enter the country must have proof of a negative PCR or antigen test. If the test results are positive, individuals must quarantine according to Peruvian regulations.
  • Officials ordered the closure of land borders and suspended foreign nationals’ ability to enter the country by land. Freight and merchandise transportation are exempt from the land border closure.

Additional Information: The government-instituted curfew will remain in effect until Aug. 22, according to alert levels by province. Peruvian and foreign residents may enter the country if they comply with health protocols set by the Ministry of Health.

The Peruvian government recently published new provisions that created new permits, changed immigration procedures and updated processing times.

New Permits:

  • Temporal Migratory Card (CTM). This identification document is issued to foreign nationals with temporary immigration status so that they may obtain an extraordinary work permit and the special permit to sign documents.
  • Extraordinary Work Permit. This permit allows foreign nationals to work and earn income for up to 60 calendar days. Foreign nationals who hold training or religious immigration status may request such permits.

New Procedures:

  • For many immigration applications, individuals must submit a government-issued document proving that they do not have a criminal record in their country of origin or where they have resided for the previous five years.
  • For the renewal of Resident Worker Immigration Status of a dependent employee, applicants must submit an Income and Withholding’s report, Consultation of Contributions report and Withholdings of Workers report issued by the National Customs and Tax Administration Superintendence (SUNAT) for the last three months.
  • For the extension of Stay Authorization of Temporary Worker Immigration Status, applicants must submit an affidavit of being compliant to the requirements that were presented in the Application of Visa or in the In-Country Process Post Arrival of Change of Immigration Status.

Processing times:

  • The law reduces the government-mandated processing times for all in-country and consular visas from 60 days to 30 business days.
  • Authorities will process Permit to Sign Documents and evaluate procedures for the Extension of Immigration Status and Extension of Stay Authorization within five business days.
  • Authorities will process exit/re-entry permits within seven business days.

Additional Information: Immigration authorities will not issue a rejection or denial letter if an application is rejected. Authorization of stay outside the country for 30 days, Permit to Sign Documents and Extraordinary Work Permits will be automatically approved after the processing time has ended.

The four full members of the Andean Community (CAN) have approved the Andean Migratory Statute, and it is intended to take effect on Aug. 13. The statute will provide reciprocal immigration benefits for Andean citizens, including temporary and permanent residency between the CAN member countries.

Key Points:

  • This new statute will facilitate free movement and residence pathways for Andean citizens through temporary and permanent residence pathways for CAN member countries.
  • The Andean Temporary Residency will authorize Andean citizens to stay for up to two years in the territory of a member country.
  • After holding the Andean Temporary Residency for two years, Andean citizens can apply for the Andean Permanent Residence which will authorize them to stay indefinitely in the territory of another CAN member country.
  • Andean citizens will have the right to work and perform any legal activity as nationals of the receiving countries as guided by the legal regulations of each country.
  • Andean citizens may enter any other member country as tourists by presenting their valid national identification documents.
  • Applications for these permits will be managed by the consular office of the destination country or by the appropriate immigration authority if the applicant is already located in the destination country.
  • According to the CAN Secretary General, Jorge Pedraza, the agreement is expected to take effect on Aug. 13.

Peru has extended its national COVID-19 emergency and updated travel and entry policies. The following policies will remain in effect until at least May 30:

  • Non-resident foreigners who have traveled from or transited through Brazil, India or South Africa within 14 days of arrival into Peru will not be permitted to enter the country until at least May 30.
  • Non-resident foreigners from the United Kingdom are permitted to enter the country as of May 8.
  • Peruvian citizens, resident foreign nationals and non-resident foreign nationals wishing to enter Peru must show proof of a negative PCR or antigen test.

Peru has extended its national COVID-19 emergency and its ban on travel from Brazil, South Africa and the United Kingdom.

Key Points:

  • Officials have extended the national emergency until April 30. Most provinces remain on “very high” or “extreme” alert, with most of the Lima region on “very high,” except for Barranca, Huaura and Huarochirí provinces, which are on “extreme” alert. Curfews and restrictions on internal travel remain in effect in most of the country. More information is available here.
  • Non-resident foreign nationals traveling from Brazil, South Africa or the United Kingdom will not be permitted to enter Peru until at least April 11. This ban does not apply to Peruvian citizens or residents, but it does apply to foreign nationals who have transited through or otherwise been present in any of the three countries in the last 14 days.
  • Flights from other countries are permitted in accordance with Ministry of Transport and Communications regulations.

Peru has banned travelers from Brazil, Europe and South Africa, extending its national state of emergency until Feb. 28 due to COVID-19.

Key Points:

  • Travelers from Brazil, Europe and South Africa will be barred from entry from Jan. 31 until Feb. 28. The ban also applies to foreign nationals who have transited through those areas, even if they are nationals of a different country.
  • Peruvian nationals and permanent residents are exempt from the restrictions.
  • The following Peruvian regions will be under a total lockdown from Jan. 31 until Feb. 14: Ancash, Apurimac, Huancavelica, Huanuco, Ica, Junin, Lima, Pasco and Provincia Constitucional del Callao.
  • The lockdown includes a curfew, the closure of all non-essential businesses, a ban on internal travel and work from home orders.

Additional Information: Peru had previously banned flights from European Union, but flights from Brazil and other countries had been allowed. Flights from Argentina, Bolivia, Canada, Chile, Colombia, Costa Rica, Cuba, the Dominican Republic, Ecuador, El Salvador, Jamaica, Mexico, Panama, Paraguay, the United States and Uruguay are still allowed.
