U.S. Citizenship and Immigration Services announced updated policy guidance on applications submitted under the International Entrepreneur Rule.

Key Points:

  • USCIS updated its Policy Manual regarding the types of evidence that may support an application for a discretionary grant of international entrepreneur parole.
  • The new guidance covers evidence of an applicant’s central, active role in a startup entity and their position to significantly grow the entity and help it succeed.
  • The update expands the types of evidence eligible to show qualified investments and qualified government awards or grants, as well as the types of alternative evidence an applicant may submit. It also clarifies the types of evidence that can support a finding of significant public benefit.

Additional Information: The updated policy is effective immediately and applies to requests pending or filed on or after Dec. 12. Further details about this new guidance is available here.
